Overtime on a Salary: When Salaried Workers Get 1.5x (2026)
Being paid a salary does not mean you are exempt from overtime. How to find your hourly rate from a salary and what your overtime hours are worth.
Salary Is How You Are Paid, Not Whether You Get Overtime
Exemption depends on three things together: you are paid a true salary, that salary clears the federal threshold, and your actual duties fit an exempt category such as executive, administrative or professional. Fail any one, and overtime is owed. A job title, an office, or a manager's business card decides nothing.
Finding the Hourly Rate Inside a Salary
For a salary that covers a 40-hour week, divide the weekly salary by 40.

If the Salary Covers More Than 40 Hours
When the agreement is that the salary covers, say, 45 hours, the divisor is 45 — so the regular rate is lower, and the hours past 40 are owed the extra half-time premium on top of the salary. Where the salary covers a fluctuating schedule under a valid arrangement, overtime hours may be owed only the half-time premium. Both routes are lawful; guessing which one applies to you is where money gets lost.
Deductions Can Break the Exemption
An exempt salary generally must be paid in full for any week in which work is performed. Docking it for a slow afternoon, a half-day of jury duty, or lost equipment can destroy the exemption for that period — making every overtime hour payable at 1.5x.
