The headline number in 2026 is the gap between states. Washington sets the highest floor at $17.13 an hour, which makes its legal minimum overtime rate $25.70. Alabama still sits at $7.25, an overtime rate of $10.88 — a difference of $14.82 for the same hour of overtime work.
The second story is daily overtime. Federal law only counts the week, so a 12-hour Monday followed by three days off produces no overtime in 45 states. In California, Alaska, Nevada, Colorado and Kentucky the same shift can trigger premium pay on the day it happens — which is why payroll teams running multi-state crews get overtime wrong more often than they expect.
2026 overtime rules, state by state
Minimum overtime rate is the state minimum wage multiplied by 1.5 — the legal floor, not what any individual earns. Federal FLSA overtime is 1.5x the regular rate after 40 hours in a workweek per the U.S. Department of Labor.
Methodology
Minimum wage figures are the rate in force for 2026 as published by each state's labor department or wage order, with the effective date recorded in the CSV. Overtime thresholds come from each state's wage-and-hour statute; where a state has no statute of its own, the federal FLSA rule is recorded. Rates are statewide — city ordinances (Seattle, Denver, New York City and others) can be higher and are out of scope.
