What the FLSA says about overtime

The Fair Labor Standards Act is the federal law that sets the minimum overtime standard in the United States. It says non-exempt employees must receive overtime pay at a rate of at least 1.5 times their regular rate for hours worked beyond 40 in a workweek.

The FLSA does not require overtime for weekends, holidays, or more than eight hours in a day unless the employer's policy or a state law says otherwise. It also does not limit the total number of hours an employee can work, only the pay rate for hours over 40.
