How Pennsylvania overtime is different from federal FLSA

Pennsylvania workers are protected by both the federal FLSA and the state Pennsylvania Minimum Wage Act (PMWA). When the two laws differ, the more worker-favorable rule applies — and on overtime, PMWA is more generous in two important ways.

First, the Pennsylvania Supreme Court in Chevalier v. General Nutrition Centers (2019) banned the fluctuating workweek (FWW) method for salaried non-exempt employees. Under PMWA, salaried non-exempt workers must receive 1.5x their regular hourly rate — not the federal 0.5x premium — for every overtime hour. This often doubles the overtime owed.
