The Important Qualification: Operated as Part of a Hospital

Standalone urgent care does not become eligible for the federal hospital 8-and-80 system merely because it provides medical treatment. A clinic operated by a hospital as part of that hospital needs a different coverage analysis.

The Department of Labor's hospital coverage guidance says clinics and dispensaries are excluded from its hospital definition unless operated by a hospital as part of the hospital. That qualification matters when a clinic bears a hospital name, belongs to a health system or shares payroll services.

This is an eligibility guide. Our 8-and-80 overtime calculation guide explains the daily and fourteen-day arithmetic once a valid arrangement applies.

Ownership and Branding Are Not the Whole Test

A health system can operate several kinds of establishment. Shared ownership alone is not enough information to assume every location is legally part of a hospital for this provision.

Ask payroll to identify the qualifying hospital or establishment and explain how your urgent-care location fits the definition. A staff badge, hospital logo or common scheduling application does not answer that legal question by itself. If the relationship is unclear, seek clarification from the Wage and Hour Division rather than choosing a payroll method from the clinic's marketing name.

A Qualifying Facility Still Needs a Prior Agreement

Section 7(j) is an exception to the ordinary federal forty-hour workweek, not a default rule for all healthcare workers. Under 29 CFR 778.601, a qualifying employer must have a prior agreement or understanding with the employee before using the fourteen-day arrangement.

The arrangement requires overtime for work beyond eight hours in a workday and beyond eighty hours in the fourteen-day period. It is not just permission to average two weeks together and ignore daily overtime. Ask for the agreement or policy and the fixed period's start and end dates. Do not infer an agreement solely from being paid every two weeks.

State requirements and other wage protections remain relevant. A valid federal arrangement does not automatically remove a more protective applicable state obligation.

Why the Choice Changes a Paycheck

Consider a non-exempt urgent-care employee working six eight-hour shifts in week one and four eight-hour shifts in week two, at a $25 regular rate with no other compensation:

  • Week one: 48 worked hours.
  • Week two: 32 worked hours.
  • Fourteen-day total: 80 worked hours.

Under the ordinary federal weekly rule, week one contains eight overtime hours. Wages are 40 × $25 + 8 × $37.50 = $1,300 for that week, plus 32 × $25 = $800 for week two: $2,100 total.

Under a valid 8-and-80 arrangement, this particular schedule has no daily hours beyond eight and no period hours beyond eighty. Straight-time wages would total $2,000 before other applicable requirements. That $100 difference shows why establishment eligibility and the prior agreement must be checked rather than assumed.

The example does not say an urgent-care employer may choose the cheaper result. The exception must actually apply. Nor does it say 8-and-80 always pays less; longer individual workdays can produce daily overtime instead.

Records to Request

  • The employer and establishment named in your employment and payroll documents.
  • The basis for treating the location as part of a hospital, if that is claimed.
  • The prior 8-and-80 agreement or understanding and its effective date.
  • Daily timecards and the recurring fourteen-day period boundaries.
  • The regular rate, including applicable bonuses and shift differentials.

Frequently Asked Questions

Does every hospital-owned urgent care qualify?

Do not assume so. The relevant question is whether it is operated by a hospital as part of the hospital and whether the other requirements apply.

Is biweekly payroll the same as an 8-and-80 agreement?

No. Pay frequency does not determine the overtime measurement period.

Who can clarify an uncertain arrangement?

Ask the U.S. Department of Labor's Wage and Hour Division or a qualified employment adviser. This article is general information, not a determination about a particular clinic.
