Where Healthcare Overtime Goes Wrong

Overtime at 1.5× base while a differential was paid

Night, weekend, charge, and preceptor premiums are nondiscretionary pay for hours worked, so overtime must be 1.5× the blended regular rate — not 1.5× your base rate.

Automatic 30-minute lunch deductions

If you covered patients through the meal period, that time is hours worked. Auto-deduct policies are one of the most litigated hospital wage issues.

8/80 applied without an agreement

An employer may only use 8/80 for hospitals and residential care facilities and only with an agreement reached before the work period. Otherwise the 40-hour rule governs.
