Where Police & Fire Overtime Goes Wrong
Using 40 hours when a 7(k) period applies
A valid 7(k) election raises the threshold, but it must be established and documented. Without it, the ordinary 40-hour rule controls and premium is owed sooner.
Longevity and specialty pay left out
Longevity, education incentive, K-9, hazardous duty, and shift pay are nondiscretionary and belong in the regular rate.
Comp time without an agreement
Compensatory time in lieu of cash requires an agreement before the work and accrues at 1.5 hours per overtime hour, capped at 480 hours for public safety.
