Where Restaurants & Hospitality Overtime Goes Wrong

Overtime figured at 1.5 × $2.13

The classic tipped-pay error. Overtime is 1.5 × the full minimum wage (or your higher regular rate), then the tip credit is subtracted — the credit never grows with the overtime multiplier.

Mandatory service charges left out

An automatic 18% party gratuity is a service charge, not a tip. It is wages and must be in the regular rate before overtime.

Dual-rate weeks averaged wrong

Working some hours as a server and some as a cook creates two rates. Overtime uses the weighted average of both unless a valid written agreement sets the rate in advance.
