Nevada pays daily overtime after 8 hours for many workers in 2026. Here is the wage threshold that decides eligibility, the 40-hour rule.
Nevada Is a Daily Overtime State — With a Catch
Nevada is one of a small group of states that pays overtime for long days, not just long weeks. But eligibility depends on how much you earn relative to the state minimum wage, and that trip-wire is what most Las Vegas and Reno workers get wrong.
Two rules run in parallel:
- . Weekly: 1.5x for hours over 40 in a workweek. This applies to virtually all non-exempt employees.
- . Daily: 1.5x for hours over 8 in any 24-hour period — but only if your regular wage is less than 1.5 times the state minimum wage.

So a housekeeper at $15.50/hour who works a 10-hour shift earns two hours of daily overtime, even if the week totals only 34 hours. A technician at $27/hour working the same shift earns nothing extra unless the week passes 40.

The 24-Hour Period, Not the Calendar Day
Nevada measures daily overtime across "any 24-hour period," which is a real trap for casino, hospitality, and healthcare schedules. A shift that ends at 2:00 a.m. and another that starts at 4:00 p.m. the same day can land inside one 24-hour window. If the combined hours pass 8, the premium is owed.
No Double Counting
You do not get paid twice for the same hour. Hours already paid as daily overtime are not counted again toward the weekly overtime calculation. The employer must pay the greater of the two computations, not both stacked on the same hour.
Example: Rosa earns $14/hour and works four 10-hour days, 40 hours total.
- Daily overtime: 2 hours per day x 4 days = 8 overtime hours
- Regular hours: 32 x $14 = $448.00
- Overtime: 8 x $21 = $168.00
- Total: $616.00
Under a weekly-only rule she would have received $560. The daily rule is worth $56 that week — about $2,900 a year on that schedule.
The 4/10 Schedule Exception
Nevada allows an employer and employee to agree in writing to a 4-day, 10-hour schedule that waives daily overtime for those regularly scheduled 10-hour shifts. Key limits:
- The agreement must be mutual and documented.
- It covers only the regularly scheduled shifts. Hours beyond 10 in a day still earn overtime.
- Weekly overtime past 40 hours still applies.
Common Nevada Situations
