Do 12-Hour Shifts Get Overtime Pay?

It depends on where you work. A 12-hour shift does not automatically trigger overtime under federal law. Under the FLSA, overtime is based on weekly hours worked (over 40), not shift length. However, several states have daily overtime laws that guarantee extra pay for long shifts.

Federal Rule: 12-Hour Shifts and the 40-Hour Week

Under federal law alone, a 12-hour shift earns the regular rate for all 12 hours — unless the total weekly hours exceed 40.

Example (Federal only — Texas, Florida, Indiana):

  • Three 12-hour shifts = 36 hours → No overtime
  • Four 12-hour shifts = 48 hours → 8 hours of overtime at 1.5×

Many nurses, EMTs, and factory workers on 12-hour schedules work three days one week and four days the next, creating an overtime swing.

States Where 12-Hour Shifts Trigger Daily Overtime

These states guarantee overtime for any hours worked beyond their daily threshold:

12-Hour Shift Schedules and Overtime Traps

The 3-on/4-off Rotation:

  • Week 1: Three 12s = 36 hours → No OT
  • Week 2: Four 12s = 48 hours → 8 hours OT

This is common in nursing and manufacturing. Workers get a big paycheck on the 4-day week but nothing extra on the 3-day week.

The 7-Day Straight Schedule:

Working 12-hour shifts 7 days in a row is 84 hours. That's 44 hours of overtime under federal law — and in Kentucky, all 12 hours on day 7 would also be at 1.5×.

Industry-Specific 12-Hour Shift Rules

Nurses and Healthcare Workers

Some states (California, Oregon, Washington) have specific rules for mandatory overtime in healthcare. In 18 states, employers cannot force nurses to work overtime except in emergencies.

Police and Firefighters

The FLSA has a partial exemption for public safety workers. Some fire departments use the "7(k) exemption" which allows longer work periods before OT applies.

Factory and Warehouse Workers

Amazon, Tesla, and other large manufacturers often use 12-hour shifts. In daily-OT states, this creates significant overtime liability for employers.

Is working 12 hours worth it for overtime?

In California, Alaska, or Nevada, yes — you automatically earn 4 hours of OT per 12-hour shift. In federal-only states, it only matters if you exceed 40 hours.

Do meal breaks count toward 12 hours?

No. Under federal law, unpaid meal breaks (typically 30+ minutes) do not count as hours worked and are not included in overtime calculations.

Can my employer schedule me for 12 hours without notice?

In most states, yes. Only a few cities and states (Seattle, NYC, Oregon) have predictive scheduling laws requiring advance notice.
