The Short Answer
Under the FLSA, a tipped employee's overtime rate is 1.5× the full federal minimum wage of $7.25 — not 1.5× the $2.13 direct cash wage. The employer can still take the tip credit against the OT rate, but the math starts from the true minimum wage. Getting this backwards is one of the most common wage-theft violations in restaurants and hotels.

Who Counts as a "Tipped Employee"?
Under 29 U.S.C. § 203(t), a tipped employee is anyone who customarily and regularly receives more than $30/month in tips. That covers servers, bartenders, bussers, bellhops, nail technicians, and delivery drivers in most states.
The 2026 FLSA Tip Credit Formula
Federal law lets employers pay a direct cash wage as low as $2.13/hour, provided tips bring the worker up to at least $7.25/hour. The difference — $5.12 — is the "tip credit."
The Correct Overtime Math
- . Start with the full minimum wage: $7.25
- . Multiply by 1.5: $10.88 (the overtime rate)
- . Subtract the tip credit ($5.12): $5.76
- . Result: the employer must pay $5.76/hour in direct cash wages for every overtime hour worked.
Wrong math (what many payroll systems do): $2.13 × 1.5 = $3.20/hr. That shorts the worker by $2.56 per overtime hour — over $130/month for a 50-hour week.
Worked Example — Server on a 50-Hour Week
Facts: Maria is a server in a federal-minimum-wage state. She worked 50 hours last week, was paid $2.13/hour direct cash, and earned $600 in tips.

If her employer had incorrectly used $2.13 × 1.5 = $3.20, her OT line would be $32.00 — a $25.60 shortfall per week, or $1,331/year in stolen wages.
State Rules That Override the Federal Tip Credit
Seven states do not allow a tip credit at all — tipped employees earn the full state minimum wage in cash before tips:
- California — $16.50/hr (all employees, tipped or not)
- Washington — $16.66/hr
- Oregon — $14.70/hr (standard rate)
- Nevada — $12.00/hr
- Alaska — $11.91/hr
- Minnesota — $11.13/hr (large employers)
- Montana — $10.55/hr (businesses over $110k gross)

The 80/20 Rule (Dual Jobs & Sidework)
Under the 2021 DOL rule (still in force in 2026), an employer cannot take the tip credit for time a tipped worker spends on "non-tip-producing" sidework if that work:
- Exceeds 20% of the workweek, OR
- Is performed for a continuous period longer than 30 minutes.

Service Charges Are NOT Tips
An automatic 18% "service charge" on parties of 6+ is the property of the employer under 29 CFR § 531.55, not a tip. If the house passes any portion to you, it counts as regular wages — which *raises* your regular rate and therefore your overtime rate. This is a huge miscalculation area for banquet servers.
Tip Pooling in 2026
- Traditional pool: allowed among customarily tipped employees (servers, bussers, bartenders).
- Non-traditional pool: allowed to include back-of-house (cooks, dishwashers) only if the employer pays full minimum wage and takes no tip credit.
- Managers and supervisors may never keep tips — even from a valid pool (29 U.S.C. § 203(m)(2)(B)).
How to Spot Wage Theft on Your Paystub

Q: Does my employer have to tell me they're taking a tip credit?
Yes. Under 29 CFR § 531.59(b), employers must give written notice of the cash wage, the credit amount, and that tips are the employee's property before taking the credit. No notice = no credit = you're owed the full minimum wage plus tips.
Q: Do credit-card processing fees come out of my tips?
Employers can deduct the actual fee percentage (usually 2–3%) from credit-card tips, but only if it doesn't drop you below minimum wage. They cannot round up or profit from the deduction.
Q: I work in California — is my overtime different?
