California Double Time: When 2x Pay Kicks In (2026 Guide)

California pays three different rates in one long shift. Where the 8-hour and 12-hour lines sit, how the seventh consecutive day works, and how the rules stack.

Three Rates, One Shift

California is the only state where a single day at work can pay straight time, time and a half, and double time — all in the same shift.

The lines sit at 8 and 12 hours:

  • Hours 1 to 8: your regular rate
  • Hours 9 to 12: one and a half times
  • Hour 13 onward: double time

A 14-hour day at $25 an hour pays $200 + $150 + $100 = $450. Paid flat, the same day would be $350. That $100 gap is the entire reason this rule exists.

The Seventh Consecutive Day

Work all seven days of your employer's workweek and the seventh day has its own schedule: the first 8 hours pay one and a half times, and everything past 8 pays double time.

This applies even if the week's total is unremarkable. Seven six-hour days is 42 hours — the seventh day's six hours are still premium hours.

The Rules Do Not Stack

California layers daily and weekly overtime but counts each hour exactly once, at the highest rate it qualifies for. Weekly overtime applies only to *straight-time* hours past 40, which excludes hours already paid at 1.5x or 2x.

Double Time Is 2x the Regular Rate

Not 2x your posted wage. The regular rate includes shift differentials, non-discretionary bonuses, piece rates and most commissions. Leave a promised bonus out and both your 1.5x and 2x hours are understated — the overtime bonus calculator shows the size of that error.

Alternative Workweeks and Exemptions

A properly adopted 4/10 or 3/12 alternative workweek shifts the daily overtime trigger to the scheduled shift length. What it does not do is remove double time past 12 hours in a day.

Exemption is about duties and a salary of at least twice the state minimum wage for full-time work — not about being handed a manager title. Misclassified salaried staff in California are among the most frequently underpaid workers in the country, often for daily overtime and double time going back years.
