How Amazon Warehouse Overtime Pay Works in 2026

Amazon operates over 1,400 fulfillment centers, sort centers, and delivery stations across the U.S., employing more than 800,000 hourly associates. All Amazon warehouse associates (Tier 1 and Tier 3) are classified as non-exempt under the FLSA — meaning they are entitled to time and a half for hours worked beyond 40 per week, plus state-specific daily overtime where applicable.

Amazon Starting Wages by Region (2026)

Amazon's base wages vary significantly by warehouse location:

  • National average starting wage: $19.00–$23.00/hour
  • California (Inland Empire, Sacramento): $20.00–$24.00/hour
  • Seattle/Bellevue (BFI, BFI4): $22.50–$26.00/hour
  • New York City Metro (JFK, LGA, EWR airports): $21.50–$25.00/hour
  • Nashville, Atlanta, Phoenix: $18.00–$21.00/hour
  • Rural facilities (Kentucky, Indiana, Mississippi): $17.00–$19.50/hour

Night shift differentials add $1.00–$1.50/hour on top of base.

How Amazon Calculates Overtime

Amazon uses the standard FLSA formula in most states:

Formula: OT Pay = Base Rate × 1.5 × Hours Over 40

Example — Texas fulfillment center associate:

  • Base wage: $19.50/hour
  • Hours worked: 50 (10 hours of mandatory extra time/MET)
  • Regular pay: 40 × $19.50 = $780.00
  • Overtime: 10 × ($19.50 × 1.5) = 10 × $29.25 = $292.50
  • Weekly gross: $1,072.50

For California, Nevada, Colorado, and Alaska workers, Amazon must also pay daily overtime after 8 hours — making Peak Season (October–January) significantly more lucrative.

California Amazon Workers: Daily OT + Double Time

California Amazon associates working mandatory 10-hour Peak shifts earn:

  • Hours 1–8: regular rate
  • Hours 8–12: 1.5× rate (daily OT)
  • Hours 12+: 2× rate (double time)

Example — Moreno Valley (ONT8) Peak Season:

  • Base: $20.50/hour, 12-hour shift
  • Regular (8 hr): $164.00
  • Daily OT (4 hr at $30.75): $123.00
  • Daily total: $287.00 (vs $246 in a non-daily-OT state)

7th consecutive day worked = first 8 hours at 1.5×, beyond 8 at 2×.

Mandatory Extra Time (MET) Rules

Amazon designates Peak Season weeks as "Mandatory Extra Time" — employees must work an additional 10–20 hours/week beyond their normal schedule. MET is enforced via attendance points (UPT/PPT system).

VTO (Voluntary Time Off) — The Other Side

When demand drops, Amazon offers VTO (unpaid) or VET-to-VTO conversion. VTO does not reduce your overtime eligibility for weeks where you worked over 40 hours. Always confirm VTO is logged correctly in A to Z to avoid lost OT.

Peak Season Pay (October–January 2026)

Amazon's 2025 Peak Season featured:

  • +$2.00/hour Peak Surge (some sites)
  • Double pay holidays: Thanksgiving, Christmas, New Year's Day
  • MET frequency: typically 4 of 13 Peak weeks

A California associate working a typical Peak schedule (50 hr/week × 8 weeks) earned approximately $10,500 extra above regular pay, with most of that coming from the daily-OT structure.

Shift Differentials Included in OT Rate

Per FLSA §207(e), Amazon must include shift differentials and Peak surge pay in the regular rate for overtime calculation. If you receive a $1.00 night differential, your OT rate is calculated on base + $1.00, not just base.

This is the most commonly underpaid item — verify your paystub.

On-the-Clock Time (Time Detection System)

Amazon's "Time Off Task" (TOT) and badging system controls when you're on the clock. The U.S. Supreme Court ruled in *Integrity Staffing Solutions v. Busk* (2014) that pre-/post-shift security screening time is not compensable under federal FLSA.

However, state law overrides this in:

  • California (per *Frlekin v. Apple*, 2020): security screening must be paid
  • Pennsylvania: same (per *Heimbach v. Amazon*, 2021)
  • Washington: pending; multiple class actions filed

How to File an Unpaid Overtime Claim Against Amazon

Are Amazon Tier 3 leads exempt from overtime?

No. Tier 3 process assistants (PAs) and L1 area managers are typically non-exempt. Only L4+ Operations Managers are FLSA-exempt (salaried, executive duties).

Does Amazon include the $2 Peak Surge in OT calculations?

Yes — required by FLSA §207(e). If your paystub shows OT at base rate only during Peak, you may be owed back wages.

Do Amazon DSP delivery drivers get overtime?
