A Shift Premium Raises Your Overtime Rate Too

If you earn $1.50 an hour extra for nights, that premium is part of your regular rate. Overtime is then 1.5 times the *higher* rate — not 1.5 times your day-shift wage.

Say $21 base, a $1.50 night differential on 24 of 46 hours worked:

| Line | Amount |

| --- | --- |

| 46 hours at $21 | $966.00 |

| Night premium (24 x $1.50) | $36.00 |

| Straight-time earnings | $1,002.00 |

| Regular rate ($1,002 / 46) | $21.78 |

| Overtime premium (6 x $10.89) | $65.35 |

| Gross pay | $1,067.35 |

Paying the 6 overtime hours at $31.50 instead of $32.67 shorts the week by about $7 — every week.

Build the Week Shift by Shift

Overtime is measured across the workweek, not the shift. Four 12-hour shifts do not create overtime by themselves at the federal level; 48 hours in one week does. Lay the shifts out in the shift calculator so start times, end times and unpaid breaks land in the right week.

Weekend and Holiday Shifts

Federal law does not require extra pay for Saturdays, Sundays or holidays. Many contracts do — and when the extra pay is a straight premium rather than true time-and-a-half, it usually counts inside the regular rate. Premiums genuinely paid at 1.5x for hours beyond 8 in a day or beyond the scheduled week can be credited against overtime owed instead.

States That Count the Day, Not the Week

California, Alaska, Nevada, Colorado and Puerto Rico add daily rules, so a long shift can create overtime in a short week. Check your rule on your state overtime page before trusting a weekly-only total.

Quick Check

Divide your total straight-time earnings by total hours worked. If that number is higher than your posted wage and your stub still pays overtime at 1.5 times the posted wage, you are being underpaid. Confirm the figure in the overtime pay calculator.
