Film Overtime Pay: Daily Guarantees vs Actual Hours Worked
Check a film crew day guarantee against actual hours, overtime tiers and contract terms. Worked examples distinguish hourly guarantees from flat day rates.
Start With the Pay Agreement, Not the Day Quote
A film crew day guarantee is not necessarily an hourly rate multiplied by hours actually worked. Before using a film overtime calculator, identify what the quoted amount buys: an hourly arrangement with a minimum payment, a flat day rate, or a contractual package that already includes specific premiums.
A call sheet records scheduling; a pay agreement establishes compensation. Neither a twelve-hour guarantee nor the word freelance automatically decides exemption status or the overtime owed. This article concerns employee payroll, not a universal union rate sheet.
Record Worked Hours Separately From Guaranteed Pay
Keep the call time, actual start and finish, qualifying unpaid meal periods, and all additional work. A guaranteed payment can cover more hours than were actually worked without turning those unworked hours into worked time for the federal weekly threshold.
Conversely, working past the guarantee can create additional wages. Do not treat the quoted day amount as permission for unlimited hours. Meal penalties, turnaround terms, travel and other production payments require their own agreement and legal analysis.
The federal regular rate generally comes from includable remuneration divided by actual hours worked. It is not always the advertised base rate; bonuses and other compensation may change it. Our regular-rate and bonus guide explains that separate issue.
California Hourly Example: A Thirteen-Hour Worked Day
Assume an adult, non-exempt daily employee covered by the ordinary daily tiers in California Wage Order 12 earns a $30 regular rate. There is no alternative workweek, special contract exception or other compensation. Thirteen actual worked hours—not thirteen hours including a genuine unpaid meal—produce:
- First eight hours: 8 × $30 = $240.
- Next four hours: 4 × $45 = $180.
- Thirteenth hour: 1 × $60 = $60.
- Daily wages: $480.
In that same simple arrangement, twelve worked hours produce $420. If a contract calls that a twelve-hour guarantee, read its actual wording before deciding whether an early wrap still pays $420 or how later work is paid. This example does not establish a required guarantee for every production.
Wage Order 12 has different provisions and exceptions for some employee arrangements. Weekly overtime, seventh-day work and qualifying collective bargaining provisions also need review. Daily and weekly statutory premiums are not simply compounded. Use the California double-time guide for the general tiers, not as a substitute for a production agreement.
Federal Flat Day Rate: A Different Calculation
Consider a hypothetical non-exempt employee governed by the ordinary federal weekly rule, with no state daily overtime requirement. The employee receives $300 per day for five days and works 50 hours total. Assume the flat day rate pays straight time for all hours and there is no other compensation.
- Weekly day-rate earnings: 5 × $300 = $1,500.
- Regular rate: $1,500 ÷ 50 = $30.
- Overtime hours: 50 − 40 = 10.
- Additional half-time premium: 10 × $15 = $150.
- Total weekly wages: $1,650.
The extra premium is half time because the day-rate earnings already cover straight time for those hours. Do not add full time-and-a-half wages on top of that straight time again. This is not the California thirteen-hour example and should not be transferred to it unchanged.
What to Ask Payroll
- Is this an hourly guarantee or a genuine flat day rate?
- Which actual worked hours and workweek boundaries were used?
- Which amounts already include straight time or overtime premiums?
- Which state wage order and production agreement apply?
- Are meal penalties and other payments shown separately?
Compare the written terms with the timecard and pay stub. The overtime calculator and California double-time calculator can check simple hourly examples; they do not interpret film contracts or custom guarantees.
Frequently Asked Questions
Does a twelve-hour guarantee mean I worked twelve hours?
No. Record the actual work separately from any promised minimum payment.
Can I divide the day quote by twelve to find my regular rate?
Not automatically. The quote may contain premiums, and a flat day-rate arrangement uses a different federal calculation based on actual weekly hours.
Do all film workers use the same overtime formula?
No. Employee status, state law, the pay arrangement and applicable contract provisions matter. This guide is general information, not legal advice.
