Payroll Compliance Checklist 2026: 25 Rules Every US Employer Must Follow
The complete 2026 payroll compliance checklist. FLSA, IRS, ACA, state wage laws, overtime, exempt classification, pay stubs, final paychecks, and penalties.
The 2026 Payroll Compliance Checklist for US Employers
Payroll compliance is where most small and mid-size businesses get burned. Between the FLSA, IRS, ACA, ERISA, and 50 state wage codes, there are literally hundreds of touchpoints. This 25-item checklist covers the ones that generate 95% of DOL and IRS penalties in 2026.
Federal Wage & Hour (FLSA)
1. Pay at least the federal minimum wage — $7.25/hr (or the state minimum, whichever is higher).
2. Pay overtime at 1.5× the regular rate for non-exempt hours over 40 in a workweek. See our FLSA overtime calculation guide.
3. Correctly classify exempt vs non-exempt. In 2026, the DOL salary threshold for exempt is $1,128/week ($58,656/year) — plus the duties test.
4. Include all remuneration in the regular rate. Non-discretionary bonuses, shift differentials, and commissions must be blended into the OT calculation (regular rate guide).
5. Never let non-exempt employees work off the clock. Emails, "just finishing up," and boot-up time all count.
6. Follow child labor rules — hour restrictions and hazardous occupation bans (14–17 age brackets).
Federal Tax Deposits & Filings
7. Deposit federal payroll taxes on schedule. Monthly or semiweekly (based on lookback period); next-day if $100k+ accumulates.
8. File Form 941 quarterly. Due April 30, July 31, Oct 31, Jan 31.
9. File Form 940 annually for FUTA (Jan 31).
10. Issue W-2s by Jan 31 and file W-3 with SSA. 1099-NEC same deadline.
11. Handle backup withholding at 24% for any 1099 recipient who fails to provide a valid TIN.
State Compliance
12. Register in every state where you have an employee. Even one remote worker triggers full compliance in that state.
13. Follow state overtime rules. California, Alaska, Colorado, and Nevada require daily overtime after 8 hrs/day. Rhode Island requires Sunday premium pay.
14. Provide compliant pay stubs. 41 states mandate written or electronic pay stubs with specific data fields (hours, rates, deductions, YTD).
15. Follow state final paycheck laws. California = same day for termination. Some states allow up to next regular payday.
16. Comply with paid sick leave / PFL laws. 18 states + DC now have statewide mandates in 2026.
Employee Classification & Onboarding
17. Verify work eligibility via Form I-9 within 3 business days of hire.
18. Report new hires to state agency within 20 days (Federal PRWORA rule).
19. Do not misclassify employees as independent contractors. IRS uses the 3-part control test; DOL uses the 6-factor economic reality test.
Benefits & ACA
20. Offer ACA-compliant coverage if 50+ FTE employees (Applicable Large Employer). File Forms 1094-C and 1095-C.
21. Follow ERISA rules for 401(k) and health plans — Summary Plan Description, Form 5500, fiduciary duties.
22. Handle COBRA notices within 44 days of a qualifying event.
Records & Notices
23. Keep payroll records the required duration — see Payroll Records Retention 2026. Default: 7 years.
24. Display required labor law posters — federal + state + local. See State Labor Law Posters 2026.
25. Provide state-required new-hire notices — CA Wage Theft Prevention Act (Labor Code § 2810.5), NY WTPA § 195, etc.
The 2026 Penalty Table (What Non-Compliance Actually Costs)
| Violation | 2026 Maximum Penalty |

| Missing I-9 | $281 – $2,789 per form |

Bottom Line
Payroll compliance in 2026 is a year-round discipline, not a January project. Build the calendar, run monthly self-audits, keep records for 7 years, and don't wing exempt classification. The employers who do this quietly avoid the $50k+ mistakes that end up in DOL press releases.
