Is Training Time Paid? FLSA Rules for Meetings and Certifications (2026)

When must an employer pay for training, meetings, and required certifications? The four-part FLSA test for 2026, with examples for healthcare, retail.

The Four-Part Test

Training time is paid unless all four of these are true (29 CFR 785.27):

  • . Attendance is outside normal working hours.
  • . Attendance is truly voluntary.
  • . The training is not directly related to your current job.
  • . You perform no productive work during it.

All four. Miss one and the hours are compensable. In practice, most employer-run training fails at least one prong, which is why the safe default is to pay for it.

Where Employers Get It Wrong

"It is voluntary." If missing the session affects your schedule, your evaluation, or your standing, it is not voluntary. Courts look at consequences, not the word in the email.

"It is on your own time." Timing alone does not exempt anything. A Saturday morning session on your own equipment still fails the test if it is job-related or effectively required.

"It is for your certification, not for us." If the certification is required to keep doing the job you already hold, the training is directly related to your job and is paid time. Training that qualifies you for a *different* job, like a warehouse worker taking an outside accounting course, is a genuine exception.

Travel and Expenses

Time spent traveling to required training during your normal work hours is work time, even on a day you would normally be off. Our travel time guide covers the overnight-trip rules in detail.

Reimbursable expenses are a separate question, but under FLSA a required expense cannot cut your effective pay below minimum wage.

Overtime Effect

Paid training hours count toward the 40-hour threshold. Eight hours of Saturday onboarding for someone already at 40 scheduled hours is eight hours of overtime. Check the impact with the time and a half calculator.

What to Do

  • Employees: save the invitation, the attendance list, and any language suggesting attendance is expected.
  • Employers: put training hours into the timekeeping system by default and carve out the rare truly voluntary session, not the reverse.
