Alaska Overtime Laws 2026: Daily 8-Hour Rule & Pay Calculator
Alaska overtime pay rules for 2026. Learn the daily 8-hour overtime law, $11.91/hour minimum wage, exemptions, and how to calculate time and a half in Alaska.
Alaska Overtime Pay Rules in 2026
Alaska is one of the few U.S. states with a daily overtime law. Under Alaska Statute 23.10.060, non-exempt employees must receive time and a half for any hours worked over 8 in a day or over 40 in a workweek — whichever threshold is reached first.
Alaska Minimum Wage in 2026
As of January 1, 2026, Alaska's minimum wage is $11.91 per hour. This rate is adjusted annually for inflation based on Anchorage Consumer Price Index changes. Unlike many states, Alaska does not have a separate tipped minimum wage — all employees earn at least $11.91/hour.
How Alaska Daily Overtime Works
The Alaska daily overtime rule applies to employers with 4 or more employees. If you work for a very small business (3 or fewer employees), only the federal 40-hour weekly rule applies.
| Hours Worked | Pay Rate | Example at $15/hr |
|---|---|---|
| First 8 hours/day | Regular rate | 8 × $15 = $120 |
| Hours 9+ in same day | 1.5× regular rate | 2 × $22.50 = $45 |
| Hours 41+ in a week | 1.5× regular rate | 1 × $22.50 = $22.50 |
Example — A Juneau seafood processor earning $16/hour works five 9-hour days (45 hours total):
- Regular pay: 40 × $16 = $640
- Daily overtime: 5 × 1 hour × $24 = $120 (1 OT hour each day)
- Total: $760 — $120 of which came from the daily rule alone.

Alaska Overtime Exemptions
Alaska recognizes the federal FLSA white-collar exemptions and adds a few state-specific ones:
- Executive, administrative, and professional employees earning at least $684/week
- Outside salespersons
- Computer professionals earning $27.63+/hour
- Certain fishing and agricultural workers (seasonal exemptions)
- Employers with 3 or fewer employees (daily OT does not apply)
- Community health aides employed by Native health organizations
- Domestic service workers in private homes
Alaska Overtime vs. Federal FLSA
| Rule | Federal FLSA | Alaska State Law |
|---|---|---|
| Weekly threshold | 40 hours | 40 hours |
| Daily threshold | None | 8 hours |
| Applies to | Most employers | Employers with 4+ employees |
| Minimum wage | $7.25/hour | $11.91/hour |
When Alaska law is more generous (which it almost always is), employers must follow the state rule.
