How Georgia Overtime Is Calculated
Georgia has no state overtime law, so the federal Fair Labor Standards Act (FLSA) controls. The formula is straightforward:
- Regular pay = hours up to 40 × hourly wage
- Overtime rate = hourly wage × 1.5
- Overtime pay = hours above 40 × overtime rate
- Total gross pay = regular pay + overtime pay
Example: A warehouse worker in Atlanta earns $19/hr and works 47 hours. Regular pay = $760 (40 × $19). Overtime = 7 × $28.50 = $199.50. Total = $959.50.
Important Override Rules
Weekly only, not daily. Georgia does not require daily overtime. A 12-hour shift earns no overtime if your weekly total stays at 40 or below.
Non-exempt only. Salaried executive, administrative, or professional employees earning $684+/week and passing the FLSA duties test are exempt — they get no overtime regardless of hours.
"Regular rate" can be higher. If you earn non-discretionary bonuses, shift differentials, or commissions, those amounts must be added into your regular rate before multiplying by 1.5. This calculator uses your base hourly wage only.
Comp time is not legal in private jobs. Private Georgia employers cannot swap overtime pay for paid time off. Public-sector employers may, under FLSA limits.
