Tipped Employee Overtime Pay (2026): The FLSA Formula for Servers, Bartenders & Delivery Drivers

The Short Answer

If you're a tipped employee — server, bartender, barback, busser, host with tip share, food runner, valet, nail tech, or tipped delivery driver — your overtime must be calculated on the full applicable minimum wage (currently $7.25/hour federal or your higher state minimum), not the reduced $2.13/hour cash wage. This rule comes from 29 CFR § 531.60 and DOL Field Operations Handbook Ch. 30d05.

Underpaying tipped overtime on the $2.13 base is the #1 wage-and-hour violation in the U.S. restaurant industry, according to DOL WHD 2024–2025 enforcement data. Here's the exact 2026 formula, two worked examples, and how to recover back pay.

The 2026 Tipped Overtime Formula (29 CFR § 531.60)

Step 1 — Determine the regular rate

The regular rate is the full minimum wage (federal $7.25 or higher state/local), not $2.13. The tip credit ($5.12 federal max) is simply a *credit* against the cash wage — it does not lower your regular rate.

Step 2 — Calculate the overtime rate

Full Minimum Wage × 1.5 = Overtime Rate

Step 3 — Subtract the tip credit

Overtime Rate − Tip Credit = Cash OT Wage Owed

Federal example: ($7.25 × 1.5) − $5.12 = $5.76/hour cash owed for overtime hours.

The illegal shortcut employers use: $2.13 × 1.5 = $3.20/hour — which is $2.56 short every overtime hour.

Worked Example 1 — Florida Server (State Min Wage $14.00 in 2026)

  • Cash wage: $8.98/hour (FL tipped min = $14.00 − $5.02 tip credit)
  • Hours worked: 50 (40 regular + 10 OT)
  • Full FL min wage: $14.00

OT rate: $14.00 × 1.5 = $21.00/hour

Cash OT owed: $21.00 − $5.02 tip credit = $15.98/hour

Regular pay: 40 × $8.98 = $359.20

OT pay: 10 × $15.98 = $159.80

Total cash wages: $519.00 (plus all tips kept)

Illegal shortcut ($2.13 method): 40 × $8.98 + 10 × ($8.98 × 1.5) = $359.20 + $134.70 = $493.90 — shorting the server $25.10 that week.

Worked Example 2 — Texas Bartender (Federal Min Wage $7.25)

  • Cash wage: $2.13/hour (TX follows federal)
  • Hours worked: 55 (40 regular + 15 OT)

OT rate: $7.25 × 1.5 = $10.88/hour

Cash OT owed: $10.88 − $5.12 = $5.76/hour

Regular pay: 40 × $2.13 = $85.20

OT pay: 15 × $5.76 = $86.40

Total cash wages: $171.60 (plus all tips kept)

Illegal shortcut: 15 × ($2.13 × 1.5) = $47.93 — shorting the bartender $38.47 that week, or ~$2,000/year.

Service Charges vs Tips — A Critical Distinction

Tips (voluntary customer gratuities) → not included in the regular rate; belong to the employee under 29 CFR § 531.52.

Mandatory service charges (e.g., "18% auto-gratuity for parties of 6+") → are wages, must be included in the regular rate under 29 CFR § 531.55, and increase your overtime rate. Many restaurants get this wrong.

The Dual Jobs / 80-20-30 Rule

Under the DOL's 2021 Final Rule (86 FR 60114) — largely restored after *Restaurant Law Center v. DOL*, 120 F.4th 163 (5th Cir. 2024) vacated one part — the tip credit can only be taken when you're doing tip-producing work or directly-supporting work. If you spend more than 20% of the workweek OR any continuous 30 minutes on non-tipped side work (cleaning bathrooms, stocking, prep before opening), your employer owes you full minimum wage for that time — plus proper OT.

The Fifth Circuit vacated the 80/20 rule in August 2024, but the underlying 29 CFR § 531.56(e) dual-jobs rule still applies nationwide, and states like California, Oregon, Washington, Nevada, Montana, Minnesota, and Alaska prohibit tip credits entirely — so no reduced tipped wage is allowed at all.

Red Flags: Signs of a Tipped OT Violation

  • Your paycheck shows $3.20/hour for overtime hours (that's $2.13 × 1.5 — illegal).
  • Your employer takes the tip credit for hours spent on side work (rolling silverware, deep cleaning, opening/closing tasks) exceeding 20% of the week.
  • Automatic service charges are treated as tips (not wages) on your pay stub.
  • You're required to tip-out non-tipped workers (managers, kitchen staff, dishwashers) — this invalidates the tip credit entirely under 29 U.S.C. § 203(m)(2)(B).
  • Manager takes a share of tips — instant tip-credit forfeit; you're owed full minimum wage for all hours.

How to Recover Unpaid Tipped Overtime

Q: Is my overtime rate really 1.5× the full minimum wage, not 1.5× my $2.13 cash wage?

Yes. 29 CFR § 531.60 is explicit: the tip credit applies only to the cash-wage obligation. The regular rate — and therefore the OT rate — is calculated on the full minimum wage.

Q: What if my tips push me above minimum wage — do I still get OT?

Yes. Tips can never satisfy the overtime premium. The employer must always pay the extra 0.5× minimum-wage premium in cash.

Q: Does the 80/20 rule still exist in 2026?
