The One Rule That Explains Everything

On prevailing wage work, only the basic hourly rate is multiplied for overtime. Fringe benefits are owed on every hour at straight time and never at 1.5 times. Once that clicks, prevailing wage overtime stops being mysterious.

What a Wage Determination Actually Says

Pull a determination from SAM.gov and each classification shows two columns:

  • Rate — the basic hourly rate
  • Fringes — the hourly benefit obligation

Add them and you have the required package. The contractor can meet the fringe obligation with bona fide benefit plan contributions, with cash, or with a mix. Workers see the split on the paystub; auditors see it on the certified payroll.

Worked Example

Classification: Electrician. Determination: 38.50 basic, 14.25 fringe. Plan contributions: 9.00 an hour. Hours: 40 straight, 10 overtime.

  • . Fringe shortfall: 14.25 minus 9.00 equals 5.25 an hour in cash.
  • . Cash straight-time rate: 38.50 plus 5.25 equals 43.75 an hour.
  • . Straight-time pay: 40 times 43.75 equals 1,750.00.
  • . Overtime premium: half of the basic rate, 19.25 an hour.
  • . Overtime cash rate: 43.75 plus 19.25 equals 63.00 an hour.
  • . Overtime pay: 10 times 63.00 equals 630.00.
  • . Cash gross: 2,380.00, plus 50 hours of plan credit at 9.00 equals 450.00 in benefits.

If the contractor had wrongly multiplied the entire package, the overtime rate would have read 79.13 and the payroll would no longer reconcile to the determination — an audit finding even though the worker was paid more.

CWHSSA: The Part With Teeth

The Contract Work Hours and Safety Standards Act applies to most federal and federally assisted contracts over 100,000 dollars. It requires 1.5 times the basic rate after 40 hours in a workweek and adds liquidated damages for each day an employee was underpaid overtime, on top of the back wages. Agencies can withhold contract funds to cover both.

State Little Davis-Bacon Acts

Around thirty states run their own prevailing wage systems on state-funded work, and several are stricter than the federal scheme:

  • California requires daily overtime after 8 hours, double time after 12, and premium pay on the seventh consecutive day on most public works, with its own DIR certified payroll portal.
  • New York applies prevailing wage supplements and enforces through the Department of Labor with debarment for repeat violations.
  • Washington and Illinois require electronic filing and publish their own classification lists.

When federal and state both apply, follow the rule that pays the worker more. Check your state page in the state directory.

Apprentices and Ratios

Apprentices may be paid a percentage of the journeyman rate only if they are registered in an approved programme and the crew stays within the allowed ratio. Exceed the ratio and every extra apprentice on site must be paid the full journeyman rate for those hours, retroactively. This is one of the most expensive routine findings on public jobs.

Site of Work

Davis-Bacon covers the physical site plus adjacent dedicated facilities such as a batch plant set up for that project. A permanent fabrication shop miles away supplying multiple jobs is generally outside the determination. Time on covered ground counts; time in the permanent shop usually does not.

How Workers Can Check Their Own Pay

  • . Find the wage determination for the project and your classification.
  • . Add the basic rate and the fringe rate to get the package.
  • . Compare the cash rate plus benefit contributions on your stub to that package.
  • . Confirm overtime equals the cash rate plus half the basic rate.
  • . If it is short, request the certified payroll — many states make it public — and file with the Wage and Hour Division or your state labor agency.
